At Frontmailer, we take permission very seriously. By creating an account and agreeing to our Terms of Use, you are also agreeing to this anti-spam policy.

The law isn't enough, it's permission that counts

While the CAN-SPAM laws are a step in the right direction for reducing the spam problem, we don't feel they go far enough. Our definition of spam goes beyond the laws in most countries and encompasses what we believe to be true permission email marketing.

Spam is any email you send to someone who hasn't given you their direct permission to contact them on the topic of the email.

But that's not enough. Permission is a fuzzy word open to interpretation. Let's get into some specific scenarios so it's clear what does and doesn't constitute permission.

What kind of email addresses are OK to send to with Frontmailer?

To send email to anyone using Frontmailer, you must have clearly obtained their permission. This could be done through:

An email newsletter subscribe form on your web site.

An opt-in checkbox on a form. This checkbox must not be checked by default, the person completing the form must willingly select the checkbox to indicate they want to hear from you.

If someone completes an offline form like a survey or enters a competition, you can only contact them if it was explained to them that they would be contacted by email AND they ticked a box indicating they would like to be contacted.

Customers who have purchased from you within the last 2 years.

If someone gives you their business card and you have explicitly asked for permission to add them to your list, you can contact them. If they dropped their business card in a fishbowl at a trade show, there must be a sign indicating they will be contacted by email about that specific topic.

Basically, you can only ever email anyone who has clearly given you permission to email them specifically about the subject you're contacting them about.

What kind of email address ARE NOT OK to send to with Frontmailer?

Anything outside the examples above doesn't equal permission in our eyes, but here are some examples to make sure we're crystal clear. By using Frontmailer, you agree not to import or send to any email address which:

You do not have explicit, provable permission to contact in relation to the topic of the email you're sending.

You bought, loaned, rented or in any way acquired from a third party, no matter what they claim about quality or permission. You need to obtain permission yourself.

You haven't contacted via email in the last 2 years. Permission doesn't age well and these people have either changed email address or won't remember giving their permission in the first place.

You scraped or copy and pasted from the web. Just because people publish their email address doesn't mean they want to hear from you.

Sure, some of these people might have given you their email address, but what's missing is your permission to email them commercial messages. Blasting promotional emails to any of these people won't be effective and will more than likely see your email marked as spam by many of your recipients.

What content MUST I include in my email?

Every email you send using Frontmailer must include the following:

A single-click unsubscribe link that instantly removes the subscriber from your list. Once they unsubscribe, you can never email them again.

The name and physical address of the sender. If you're sending an email for your client, you'll need to include your client's details instead.

How we'll know if you don't have permission

Frontmailer has numerous layers of approval and monitoring to ensure you comply with our anti-spam policy. Here's a few of them:

Until your account has been approved by a member of our team, every email you send will need to be approved.

Our software is directly integrated into the spam reporting systems for some of the biggest ISP's like Hotmail and AOL. If you don't have permission and someone marks your campaign as spam, we'll know about it the moment that button is pressed. If you receive a complaint rate greater than 0.25% of all recipients (that's 25 complaints for every 10,000 recipients) your account will be terminated. This is a generous figure that takes into account false spam reports.

Our team verifies all large lists imported into our software. Until we've given it the all clear, you can't send to it.

We monitor blacklists and our abuse accounts all day every day. We can pinpoint who is causing us delivery problems or attracting complaints very easily.

If we do discover that you're emailing people without their permission, we will terminate your account with Frontmailer immediately.

In the end, it's really common sense. Take off your marketing hat and put yourself in your recipient's shoes. If they don't recognise who you are or aren't interested in what you're sending, they'll think you're a spammer. It's that simple.

If you have any questions about our Anti-Spam Policy, or if you want to report spamming activity by one of our customers, please contact our abuse department at:

Postal Address
Frontmedia Studio Ltd
Suite 5 Courtyard Offices
Braxted Park
Great Braxted Park
Essex CM8 3GA
UK

Telephone
+44 (0)1621 890220

Email
info@frontmailer.co.uk

All such changes shall become effective upon posting of the revised Agreement on the Service.

1.2 The Services are available only to persons who can form legally binding contracts under applicable law. Frontmailer reserves the right to refuse registration of, or cancel, accounts it deems inappropriate.

1.8 It is understood that Frontmailer makes no guarantee that HTML messages will be rendered properly on all recipients" e-mail programs, due to the wide variety of HTML generation tools available. Frontmailer makes every attempt to make sure that all e-mail messages sent through our servers follow e-mail standards, but we cannot guarantee that messages will look consistent across all e-mail platforms due to the number of different HTML composition tools available. For example, if you use Microsoft Word to generate HTML e-mail messages, it is expected that recipients of your message using a non-Microsoft e-mail application may have difficulty reading your message. For best results Frontmailer recommends, but does not guarantee, the use of HTML editors that generate HTML that adheres to W3C standards.

2. Restrictions and Responsibilities

2.1 This is an Agreement for Services, and you are not granted a license to any software by this Agreement. Additionally, Frontmailer may work in a limited manner on a non-Internet Explorer web browser (such as Netscape Navigator), but there is no guarantee of full functionality on web browsers other than Microsoft"s Internet Explorer.

9. Compliance rules for sending e-mail

All Frontmailer customers must follow the rules of the federal CAN-SPAM act and Frontmailer's Anti-Spam policy when sending e-mail through the service. Accordingly, we require the following of e-mail messages sent through the Frontmailer system:

All e-mails must contain a one-click unsubscribe link. Frontmailer scans every campaign for the existance of an unsubscribe link. If an unsubscribe link is not detected, the user is informed and is recommended to include an unsubscribe link before continuing.

All e-mails must contain non-Internet contact information of the sender, such as your company's address, or your company's phone number.

All e-mails must state the reason the recipient is receiving the message. For example, "You are receiving this message from ABC Company because you signed up for our e-mail list at www.abc.com."

These 3 guidelines will help ensure that Frontmailer maintains its reputation and white-listing status with a number of major ISPs and whitelisting programs. If at any time your campaign is flagged as SPAM by an AOL recipient, Frontmailer reserves the right to cancel your account without notice.

10. Email and Permission Practices

10.1 Every email message sent in connection with the Services must contain an "unsubscribe" link or other mechanism that allows subscribers to remove themselves from your mailing list. Each such link must remain operational for a period of thirty (30) days after the date on which you send the message, and must be in form and substance satisfactory to Frontmailer. You acknowledge and agree that you will not remove, disable or attempt to remove or disable either link.

10.2 You agree to import, access or otherwise use only permission-based lists (note: purchased lists may not be used; please contact Frontmailer if you have questions).

10.3 You cannot mail to distribution lists, newsgroups, or spam email addresses.

10.4 You are responsible for monitoring, correcting, processing unsubscribe requests within 10 days, and updating the email addresses to which messages are sent through your Frontmailer account.

10.5 Emails that you send through the Service may generate abuse complaints from recipients. You are responsible for ensuring that your email campaigns do not generate a number of abuse complaints in excess of industry norms. Frontmailer, in its sole discretion, shall determine whether your level of abuse complaints is within industry norms, and its determination shall be final, binding and conclusive for all purposes under this Agreement.

10.6 Frontmailer, at its own discretion, may immediately disable your access without refund to the Services if Frontmailer believes in its sole discretion that you have violated any of the email and permission practices listed above, or the Frontmailer Anti-Spam Policy.

At Frontmailer, we respect the privacy needs of our valued customers and members. This Privacy Policy outlines what specific information is gathered on the Frontmailer site and how that information is used.

Maintaining the privacy of your information is of paramount importance to us as it helps foster confidence, goodwill and stronger relationships with you, our customers. Financial information that is collected is used to verify, identity and to bill either you or your company for products and services, as applicable. Demographic and profile data collected by Frontmailer may be used to tailor this website or any requested email communications, and to display information that is more relevant to you. Frontmailer also compiles demographic and product use information, but in the aggregate only, and may make that aggregate information publicly available. Under no circumstances will Frontmailer make any personal information about an individual user available to anyone.

Your email address is used to only send you information that you have requested. As part of your use of our email marketing software, Frontmailer allows you to elect to receive, or not receive, certain information from Frontmailer. Frontmailer adheres strictly to permission-based email policy. Except as mentioned above, Frontmailer will not send you unsolicited email information, commercial offers or advertisements. Frontmailer will not sell, rent, or loan our contact lists or our customer's contact lists (including customer data) to any outside firms nor will Frontmailer use customer contact lists for our own marketing purposes. Unsubscribe requests are fulfilled within minutes and no further communications will be sent to users who have stated that they do not wish to receive the specified information.

Subscriber Lists, Campaign Content and Campaign Reports

Frontmailer ensures that all subscriber lists, email content and reports remain private and confidential. Frontmailer may scan the content of your campaigns to ensure it complies with our Terms of Use to protect against defamatory, inaccurate, abusive, obscene, profane, or threatening material that is racially or ethnically offensive. Frontmailer will not sell, rent, loan or invite external access to a customer's contact lists. Nor will Frontmailer themselves use customer's contact lists for any purpose.

Communications from the Site

Special Offers and Updates

We send all new users a welcoming email to verify their new account and confirm their password and username. Established users will occasionally receive information on products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Customers can unsubscribe via the unsubscribe mechanism at the bottom of each email.

Newsletter

If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address. Out of respect for our users privacy we provide a way to opt-out of these communications via the unsubscribe mechanism at the bottom of each email.

Service Announcements

On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an email. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.

Customer Service

We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account we reply via email or phone, in accordance with the user's wishes.

Website Usage Information

We use your IP address to help diagnose problems with our server, and to administer our Web site. We do not link your IP address to any personally identifiable information. We use tracking information to determine which areas our site users visit based on traffic to those areas. Frontmailer does not track what individual users read, but rather how often each page is visited. This helps us maintain a superior and informative website for you.

Security Technology

Frontmailer has made a substantial investment in the latest server, database, backup and firewall technologies to protect our information assets. These technologies are deployed as part of sophisticated security architecture. All data resides in a tightly controlled, secure data center. These investments mean that information about the identity and preferences of individual members is never accessible to anyone outside Frontmailer. We will maintain safeguards to protect the security of these servers and your personally identifiable information.

Policy Modifications

We may change this Privacy Policy from time to time. If/when Frontmailer makes changes to this privacy statement, we will highlight the changes on our homepage and email users who have given us permission to do so. We will post any changes here, so be sure to check back periodically. However, please be assured that if the Privacy Policy changes in the future, we will not use the personal information you have submitted to us under this Privacy Policy in a manner that is materially inconsistent with this Privacy Policy, without your prior consent.

Contacting Frontmailer about Privacy

If you have any questions about our privacy statement, the information we have collected from you online, the practices of this site, or your dealings with this web site, please contact us:

Postal Address
Frontmedia Studio Ltd
Suite 5 Courtyard Offices
Braxted Park
Great Braxted Park
Essex CM8 3GA
UK

Telephone
+44 (0)1621 890220

Email
info@frontmailer.co.uk

Who or what is Frontmailer?

Frontmailer is Frontmedia's very own email system that allows even the most heinously computer illiterate user to create and send professionally-designed HTML emails to their clients, prospective clients, family, pets, or whoever, in just a few minutes. Users can choose from a range of quality free templates or opt to use their own custom design(s). Subscriber lists can be uploaded and managed incredibly easily and once the campaign has been sent, you can monitor in real-time, who has opened the email, how many times, what links they've clicked, what their favourite food is (OK, so the last one wasn't actually true but you get the idea) and more.

It's completely FREE to send five emails or fewer. More than that and there are some very modest fees involved, but it is still by far the most (cost) effective way of reaching you target market. So, if you're not signed up yet, why not give it a try.

Who are Frontmedia?

Frontmedia is a multi-disciplinary design studio based in the UK (and yes, we really do work at the place in the picture above). We specialise in original thinking, simplicity and creative, effective design solutions.

It's simple really. At the risk of sounding like a football manager, there really is no substitute for experience and we've got bags of it (so much so in fact, that we're having to wedge some of them on top of the bookcase to make a bit more space in the studio). Since 1998 we've worked on a wide variety of successful projects both online and offline for clients ranging from small-scale start-up companies, to high-profile corporates.

If you need a website, intranet, corporate identity, interactive CD, business stationery, product catalogue, company report, flash game or anything else for that matter, why not take a look at our portfolio, quietly congratulate yourself on finding us and then give us a call (or e-mail us if you don't like telephones.)

Registered Company Details

Frontmedia Studio Limited is registered as a private limited company in England and Wales.

Registered address:
Suite 5, Courtyard Offices,
Braxted Park,
Gt. Braxted,
Essex CM8 3GA.

Registered company number: 4868638.

We stand by our claim that Frontmailer is simple and easy to use, but we all need a bit of guidance or encouragement to jump in sometimes. Our support package will offer you free Frontmailer support on an ongoing basis. Let us get you started, demonstrate the finer details of the Frontmailer system, or offer advice on how to improve your next campaign.

Call our helpline (her name is Hayley)

You won’t be put on hold and you certainly won’t be asked any security questions. Hayley is part of the Frontmedia team, based in the office, and will know who you are (not in a weird way, but in an excellent customer service kind of way.)

Whether you would like to ask a quick question or need a step by step guided tour of the process, her friendly advice and Frontmailer knowledge will get you sorted.

Maybe even ask Hayley to have a look at your campaign report to spot some ways to make your next mailer even better.

Call Hayley on 01621 890218

Download the Frontmailer Guide

If you prefer emails to phone calls, then maybe choose to download the Frontmailer Guide instead.

Offering simple, step by step instructions on creating and sending an HTML email, the Frontmailer Guide is the perfect companion to work through the system in your own time with. The guide is split into handy sections allowing you to simply skip to the bit you are having trouble with.

We also share some little gems of our email marketing knowledge in the form of ‘Handy Hints’ so be sure to look out for these along the way.

Download Frontmailer Set up Guide
